Listing
When
listing your home with a real estate company you are required to sign a listing agreement. A listing agreement is an employment contract whereby a property owner (seller) employs a real estate broker to look for a buyer for the property described in the contract and to compensate the agent.
Selling (Buying)
When
a buyer working with a real estate broker finds a home they would like to purchase, the agent or broker helps the buyer make an offer on the home. If the offer is accepted it then becomes a contract. A sales contract is an agreement between the seller and buyer on the price and other terms and conditions of the sale of the property.
Property Management
When
employing a real estate broker to manage your rental property you will be asked to sign a property management agreement. This agreement is an employment contract setting up the agency relationship between the property owner and the real estate agent that gives the agent the responsibility of managing the property, including such responsibilities as negotiation, leases, repairing and maintaining the property, collecting rents and accounting for funds.
